1. Acceptance of Terms

By accessing or using MyADASiteAudit.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Service. These Terms apply to all visitors, customers, and others who access or use the Service.

2. Description of Service

MyADASiteAudit.com provides automated website accessibility audits based on the Web Content Accessibility Guidelines (WCAG) 2.1 and 2.2 Level AA standards. The Service includes a one-time audit scan, a downloadable PDF compliance report, and an optional monthly monitoring subscription that rescans your website and alerts you to changes in your compliance status.

3. No Legal Advice

The audit reports, compliance scores, and recommendations generated by the Service are provided for informational purposes only and do not constitute legal advice. MyADASiteAudit.com is not a law firm and does not provide legal representation. No attorney-client relationship is created by your use of the Service.

We strongly recommend consulting a qualified attorney regarding your specific obligations under the Americans with Disabilities Act (ADA), Section 508 of the Rehabilitation Act, or any applicable state law.

4. No Guarantee of Compliance or Legal Protection

A passing audit score or completed audit report does not guarantee that your website is fully compliant with the ADA, WCAG, or any other applicable accessibility standard, nor does it guarantee immunity from ADA-related complaints, demand letters, or litigation. Accessibility standards evolve, website content changes, and automated tools have inherent limitations that may cause issues to be missed or misclassified.

Use of this Service does not create a safe harbor against any legal claim. MyADASiteAudit.com expressly disclaims any warranty that the Service will protect you from legal liability.

5. Payments and Subscriptions

The one-time audit fee is $99 USD and is charged at the time of purchase. After a 30-day free trial period, the monthly monitoring subscription is billed at $9 USD per month on a recurring basis until cancelled.

All fees are non-refundable except as required by applicable law. You may cancel your monthly subscription at any time from your dashboard. Cancellation takes effect at the end of the current billing period; you retain access through that date.

6. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@myadasiteaudit.com of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.

7. Acceptable Use

You agree not to use the Service to: (a) audit websites you do not own or have explicit authorization to audit; (b) resell or redistribute audit reports without our prior written consent; (c) attempt to reverse-engineer, scrape, or otherwise extract the underlying audit engine; (d) submit false or misleading information; or (e) violate any applicable law or regulation.

8. Intellectual Property

The Service, including its software, audit engine, report templates, branding, and content, is owned by MyADASiteAudit.com and is protected by copyright, trademark, and other intellectual property laws. Your audit report is licensed to you for your internal business use only. You may not republish, resell, or create derivative works from our report templates without written permission.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT DEFECTS WILL BE CORRECTED.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MYADASITEAUDIT.COM AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $100 USD.

11. Indemnification

You agree to indemnify, defend, and hold harmless MyADASiteAudit.com and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable attorney fees — arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your infringement of any third-party rights.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-law provisions. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to the personal jurisdiction of those courts.

13. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page and, where feasible, notify you by email. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.
